TERMS OF SERVICE

OVERVIEW
This website is operated by GhostPixel. Throughout the site, the terms “we”, “us” and “our” refer to GhostPixel. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

SECTION 1 - NATURE OF GOODS (MODIFIED HARDWARE)
By purchasing from GhostPixel, you acknowledge and agree to the following:

  1. Open Box: Our devices are brand new Google Pixel units that have been unsealed by our technicians solely for the purpose of installing GrapheneOS and verifying hardware integrity. They are re-sealed after this process. You accept that the device will not arrive in factory-sealed shrink wrap.

  2. Software: We provide the service of flashing the GrapheneOS operating system. GhostPixel is an independent retailer and is not affiliated with the GrapheneOS project or Google. We do not own the software.

  3. Bootloader: The bootloader is re-locked for security.

SECTION 2 - AUSTRALIAN CONSUMER LAW & WARRANTY
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

GhostPixel 12-Month Warranty:
In addition to your rights under the ACL, we provide a 12-month warranty covering:

  • Hardware defects (screen, battery, camera, motherboard).

  • Software installation failures (boot loops upon arrival).

Warranty Exclusions:
This warranty is VOID if:

  • The device has been physically damaged (drops, water damage, cracked screens).

  • The user attempts to modify the operating system, root the device, or unlock the bootloader, resulting in a "bricked" device.

  • The device is opened or tampered with by a third party.

SECTION 3 - RETURNS AND REFUNDS

  • Change of Mind: We offer a 14-day return policy for change of mind, provided the item is unused, in the same condition that you received it, and in its original packaging. A restocking fee of 10% may apply to cover initial shipping and handling costs.

  • Defective Items: If an item is defective upon arrival, please contact us immediately at support@ghostpixel.au for a prepaid return label and replacement.

SECTION 4 - LIMITATION OF LIABILITY & LAWFUL USE
GhostPixel provides privacy-focused hardware tools. By purchasing our products, you agree that:

  1. You will use the device in compliance with all Australian State and Federal laws.

  2. GhostPixel is not liable for any illegal acts committed using our devices.

  3. GhostPixel is not liable for data loss. You are responsible for your own backups.

  4. GhostPixel is not liable for bugs, updates, or changes made by the GrapheneOS developers that may affect app compatibility (e.g., specific banking apps updating their security protocols).

SECTION 5 - SHIPPING AND DELIVERY

  • All stock is dispatched from Sydney, NSW.

  • We are not responsible for delays caused by Australia Post once the item has been handed over.

  • If a package is marked as "Delivered" by the carrier but you have not received it, we will assist in the investigation, but we are not liable for theft after delivery.

SECTION 6 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New South Wales, Australia.
